Marriage concept


In accordance with the Family Code of the Russian Federation, marriage is considered to be the union of a man and a woman, which:

  • legally established;
  • concluded by mutual voluntary consent;
  • aims to create a real, not fictitious family;
  • creates rights and obligations of a reciprocal nature.

After applying to the registry office and the marriage procedure, the rights of both parties are protected at the legal level. Their property and personal rights are regulated by the legislation of the Russian Federation.
Important! A civil marriage without filing an application and signature has no legal status (with the exception of signing a marriage contract).

Restrictions on marriage registration

Refusal to register a marital relationship is possible for the following reasons:

  • medical, including if the young couple is related by close blood ties;
  • moral – between adopted and adoptive parents;
  • if one of the couple is incapacitated;
  • if you do not meet the marriageable age;
  • one of the future spouses is drunk or under the influence of drugs;
  • the marriage is actually fictitious, there is no goal of creating a full-fledged family for running a common household and having children;
  • when the bride or groom has not officially dissolved the previous marital ties.


When one party is not yet an adult, but the fact of pregnancy is confirmed, the painting is carried out with a special permit. Then the permissible age for a marital union is reduced to 16, and sometimes to 14 years, but only with the consent of guardians or parents.

Required documents

  • passports of both parties;
  • a receipt confirming payment of the duty;

The marital union of a citizen of the Russian Federation with a citizen from the CIS is registered in all registry offices of the country, and with a citizen from the Far Abroad - only in some registry offices of Moscow and St. Petersburg.

Is it possible with a military ID?

You cannot apply for registration using a military ID because it is not considered an identity document. The cadet should submit an application according to the general rules.

Choosing a registry office

In order to get married, it is not necessary to choose a registry office that corresponds to your place of registration. What is the price?

The state fee for filing a general application is 350 rubles. If one of the parties is not present in person when submitting an application, then two separate documents are submitted - from each party. In this case, the amount will double.

Important! Heroes of the Soviet Union, Heroes of the Russian Federation, full holders of the Order of Glory and participants, disabled people of the Second World War do not need to pay state duty. To exercise this right, it is enough to present a certificate confirming these merits.

You can pay the state fee at any bank, through a terminal or using Internet banking.

When is the best time?

Almost throughout the entire territory of the Russian Federation there is still a rule according to which you need to submit an application a couple of months before the planned wedding date. But the law obliges it to be submitted no later than one month before the wedding.

Some registry offices accept applications 3 months in advance. If you focus on the maximum period, with a huge number of people wishing to tie themselves into family ties during the busy season, there is a chance to sign on the day of your choice.

Reducing the period between marriage and submission of an application by young people is permissible in the following cases:

  1. Pregnancy of the bride - if the period is more than 12 weeks (confirmed by a medical certificate);
  2. Have common children (child's birth certificate required);
  3. Something threatens the life and health of one of the parties;
  4. Departure on an urgent business trip for a long period (certificate from the place of work);
  5. Conscription for military service;
  6. Critical health condition (medical certificate required).

When to serve

Newlyweds are not prohibited from choosing any day to celebrate their wedding. If the registry office cannot hold an event on the selected date due to lack of free time, you can always find out if this date is available in another department.

Marriage registration takes place at least a month after filing papers for registration.

If weddings are planned in the spring and fall seasons, then the department may need several months.


In general, checking the documents and applications provided by the newlyweds takes the state up to six months. Therefore, it is better not to delay submission, but to fill out all forms on time.

Serving alone

When one of the parties, due to objective reasons provided for by the Family Code of the Russian Federation, is absent, but wishes to get married, instead of one general one, two separate applications are submitted - from the person present and from the second party with a notarized signature. Then the size of the state duty doubles.

Important! To register a marital relationship, the presence of both parties is required.

In critical situations, painting is possible with the participation of only one of the parties. The only obligatory condition will be the presence of a document confirming a valid reason for the absence of the other party. Under these circumstances, the registration of young people will take place as soon as possible - on the day of submission of the application. But in this case there is no need to prepare for the ceremony.

What days can I submit?

The operating hours of registry offices are the same in almost all major cities of the Russian Federation:

  • from Tuesday to Saturday applications are accepted from 9 am to 17 pm;
  • lunch break - from 14 to 15;
  • ceremonial painting - Friday, Saturday;
  • regular painting - any day, except weekends;
  • Weekends – Sunday, Monday, last Thursday of each month.

In small settlements, the operating hours are specified on site. The ceremonial registration traditionally falls on the same days, and the days for accepting applications are reduced to 2-3 per week.

How to register correctly during pregnancy?

Provided that the pregnancy is more than 12 weeks, the bride can exercise the right to speed up the painting process. Then the young couple will be signed on the day of submitting the application, if there is free time. If there are no “windows”, the wedding will take place the next day.

The application procedure has a number of features. Necessary:

  1. make a photocopy of passports, collect the necessary documents;
  2. pay the state fee;
  3. take a temporary residence permit - for painting at a location other than your place of registration;
  4. obtain a certificate from the doctor who is caring for the pregnancy (it indicates the full name of the bride, gestational age, ultrasound results and date of issue);
  5. attend a personal appointment with a civil registry office employee;
  6. write an application and submit it with the necessary package of documents.

If there is a medical certificate confirming the fact of the bride’s pregnancy and the rest of the list of necessary documents, the young couple has the right to demand accelerated registration of the marital relationship.

Required documents

The main thing that will be required for the official procedure is documents. To submit an application, you will need valid civil passports of the bride and groom, as well as a receipt for payment of the state duty, which currently amounts to 350 rubles.

If the future spouses, or one of them, have not reached the age of majority, then permission to marry will also be required from the district administration. In accordance with the laws, marriage is allowed from the age of 14 in Moscow and the region, but only in extraordinary situations.   • Minors under 14 years of age.

  • Incapacitated adoptive parent and adopted child.

Neither advanced age nor a significant difference in the ages of future spouses is an obstacle to marriage.

If your other half is a citizen of another country

Despite the fact that weddings between Russian citizens and foreigners in Moscow are quite common, the procedure for officially registering the relationship of such couples is quite complicated.

When submitting documents, the other half, who is a foreign citizen, provides the following package of documents: a residence permit or a certificate from the embassy about the absence of a spouse in their home country, a divorce certificate or a death certificate of the husband or wife, if necessary.

Online registration: why not?

To do this, you need to go to the website of the capital's Wedding Palace or to the website of state or municipal services, register there and log into your account using your login and password. You can fill out an application using the website 6 months before the celebration. Agree, this is very convenient, especially if you are planning a celebration during the “wedding season.”

Select the date of registration

Take the issue of choosing a date seriously. Consider financial capabilities, personal circumstances, family traditions and other factors.

If you decide to hold a celebration in the midst of the wedding season, late spring early autumn, then you will need to book a date many months in advance. The question of choosing a surname

The legislation of the Russian Federation allows the following options:

  • Wife and husband leave their last names
  • The wife takes her husband's surname
  • Husband takes wife's surname
  • Husband and wife combine their surnames

Decide this issue in advance so that you don’t have to make a hasty choice when applying. When making decisions, remember that if you change your last name, you will also have to change a number of important documents: international passport, citizen’s passport, work book, title documents for property, insurance policy. Consult with your husband and decide which option is best for your family. Do not listen to relatives who will begin to argue that the wife is obliged to take her husband’s surname. Changing registration deadlines: in what cases is it possible?

Usually, a period of 1 month is given to make a decision and prepare for the celebration. But for the convenience of the newlyweds, there are circumstances that extend or shorten this period.

Relationships can be registered on the day of application if:

  • A woman is expecting a child.
  • The man is in military service.
  • The couple already has children together.
  • There is a threat to the life of the bride or groom.

The registration date is postponed if one of the couple is seriously ill or is forced to go on a business trip. Then the standard period can be increased by no more than 1 month.

Exceptional cases

It may also happen that one of the young couple will not be present when submitting documents to the registry office. And deadlines can be very tight. In order not to be left without a reserved date for the celebration, only one party can submit an application. Documents of the absent party must be certified by a notary. Solemnly or without witnesses

Each couple must decide for themselves what they want more: a magnificent traditional wedding with the release of birds, biting off a loaf, solemn promises, or a simple registration. The only difference is the time required for the procedure of becoming a legal husband and wife. With regular registration, you will have to spend a maximum of 10 minutes, and after that, leave the Wedding Palace with your marriage certificate and passports with fresh stamps.

When choosing, take into account the fact that if the wedding takes place at the height of the season, the Wedding Palace will be crowded with excited couples and their relatives. If you don’t want to get into conflicts and plan to protect your dress in a crowded crowd, then you should either register your relationship in winter or order an on-site registration.

When can you apply?

Before going to the registry office, you should call and clarify the office’s opening hours. Many branches are closed on Sundays and Mondays. There are also registry offices that accept applications any day of the week.

Check with your chosen branch to see if there are any restrictions. For example, there is often a ban on scattering rose petals, rice and sweets throughout the territory. You should also not break plates, glasses, drink alcohol or smoke. In which registry office and MFC are receptions conducted?

An application for marriage registration is submitted to any registry office at the place of residence. If you want the solemn wedding to take place in another city of the Russian Federation, you can take a certificate of temporary registration in the selected locality (at least one future spouse must have temporary registration).

Where can I apply? Choose a convenient option:

  1. In the registry office at the place of permanent or temporary registration of the bride and groom;
  2. In the local branch of the MFC - multifunctional center;
  3. Fill out the electronic application on the State Services portal.

Important! Regardless of the method of application chosen by the bride and groom, marriage registration will take place in one designated place - the registry office. Exceptions include cases of on-site registration and a ceremony at the Wedding Palace.

Reasons for refusal

Failure to comply with the requirements for future spouses may be grounds for marriage.
So, if one of them is in another marriage or is declared incompetent, registration will be denied. Today, it is possible to obtain documents for a legal marriage at the registry office, either by one spouse or by both of them.

Submitting an application form is a mandatory procedure to formalize your relationship under the law. The application can be submitted by one of the young people, if the second one has agreed, and his consent has been confirmed by a notary.


If it is possible to come and submit an application together, the couple fills out one application for registration of a state marriage, in which separate fields are filled in for each of the newlyweds. If only one person comes to submit an application, young people must fill out two different forms.

  • passport data;
  • date of birth;
  • age;

  • citizenship;
  • information about the dissolution of a previous marriage;

Who can formalize the relationship

Citizens who have reached the age of majority can legally marry. Marriage in special cases (for example, when the bride is pregnant) is possible from the date of receipt of a general passport, that is, when the spouses reach 14 years of age, but this may require permission from the regional governor.

In this case, the consent of the parents (or guardians) of the young couple for an official marriage, certified by a notary, is required. Parents must also be present when filling out documents at the registry office.

Couples in which blood relatives want to become spouses cannot be officially registered as husband and wife.

If one spouse is an adoptive parent and the other is an adopted child, such couples cannot apply. Or if one of the spouses has a document stating incapacity, the couple cannot submit an application either.

Also, if one of the spouses is married or married, and the spouse is not missing or deceased, such a marriage also cannot be formalized legally.

  • birth of a child;
